Terms and Conditions

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

  1. Terms and Conditions
    1. These terms and conditions (the "Terms and Conditions") govern the use of the Carers Trust Virtual Carers Centre (the "Site"). This Site is owned and operated by Carers Trust, a registered charity (Charity Nos: 1145181 / SC042870 and company limited by guarantee under company number 7697170 whose registered office is Carers Trust, 10 Regent Place, Rugby, CV21 2PN (“Carers Trust”); This Site is an online platform for unpaid carers, providing them with access to specialist support and advice, resourcing and to connect with other unpaid carers.
    2. These terms and conditions apply between you, the User of this Site (including any sub-domains, unless expressly excluded by their own terms and conditions), and Carers Trust Please read these  terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Site. If you do not agree to be bound by these terms and conditions, you should stop using the Site immediately.
    3. In these terms and conditions, User or Users means any third party that accesses the Site and is not either (i) employed by Carers Trust and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Carers Trust and accessing the Site in connection with the provision of such services.
    4. By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
  2. Intellectual Property
    1. All content published and made available on our Site is the property of Carers Trust and the Site's creators. In these terms and conditions, Content means any text, graphics, images, audio, video, software, data compilations, page layout, underlying code and software and any other form of information capable of being stored in a computer that appears on or forms part of this Site, including any such content uploaded by Users.
    2. By continuing to use the Site you acknowledge that such Content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission
    3. You may, for your own personal, non-commercial use only, do the following: retrieve, display and view the Content on a device. You must not otherwise reproduce, modify, copy, distribute or use for commercial purposes any Content without the written permission of Carers Trust.
  3. Registration
    1. You must ensure that the details provided by you on registration or at any time are correct and complete.
    2. You must inform us immediately of any changes to the information that you provide when registering by updating your personal details to ensure we can communicate with you effectively.  We may suspend or cancel your registration with immediate effect for any reasonable purposes or if you breach these terms and conditions.
    3. You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the Site. Cancellation or suspension of your registration does not affect any statutory rights.
  4. Age Restrictions
    1. The minimum age to use our Site is 13 years old. By using this Site, users agree that they are over 13 years old. We do not assume any legal responsibility for false statements about age.
  5. Acceptable Use
    1. As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
      - Abuse, harass, threaten or mistreat other users of our Site;
      - Violate the rights of other users of our Site;
      - Violate the intellectual property rights of the Site owners or any third party to the Site;
      - Hack into the account of another user of the Site;
      - Act in any way that could be considered fraudulent; or
      - Post any material that may be deemed inappropriate or offensive.

You may not upload to, distribute or otherwise publish through the Site any Content that (i) is confidential, proprietary, false, fraudulent, libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, infringing on intellectual property rights, abusive, illegal or otherwise objectionable; (ii) may constitute or encourage a criminal offence, violate the rights of any party or otherwise give rise to liability or violate any law; or (iii) may contain software viruses, political campaigning, chain letters, mass mailings, or any form of "spam."
    4. You may not use a false email address or other identifying information, impersonate any person or entity or otherwise mislead as to the origin of any content. You may not upload commercial content onto the Site.
    5. You represent and warrant that you own or otherwise control all the rights to the Content you post; that the Content is accurate; that use of the Content you supply does not violate any provision of these terms and conditions and will not cause injury to any person; and that you will indemnify Carers Trust for all claims resulting from Content you supply.
    6. If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.
  6. User Contributions
    1. Users may post the following information on our Site: Photos;Videos; and Public comments.
  7. Accounts
    1. When you create an account on our Site, you agree to the following:
      1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
      2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
    2. We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
  8. Third Party Goods and Services
    1. Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.
    2. Any online facilities, tools, services or information that Carers Trust makes available through the Site (the Service) is provided "as is" and on an "as available" basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.

    1. Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.
    2. We assume no responsibility for the content of such Websites and disclaim liability for any and all forms of loss or damage arising out of the use of them.

  11. Availability of the Site and Disclaimers
    1. Whilst Carers Trust uses reasonable endeavours to ensure that the Site is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.
    2. Carers Trust accepts no liability for any disruption or non-availability of the Site.
    3. Carers Trust reserves the right to alter, suspend or discontinue any part (or the whole) of the Site including, but not limited to, any products and/or services available.
    4. These terms and conditions shall continue to apply to any modified version of the Site unless it is expressly stated otherwise.
  12. Limitation of Liability
    1. Carers Trust and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
  13. Indemnity
    1. Except where prohibited by law, by using this Site you indemnify and hold harmless Carers Trust and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
  14. Dispute Resolution
    1. Subject to any exceptions specified in these Terms and Conditions, if you and Carers Trust are unable to resolve any dispute through informal discussion, then you and Carers Trust agree to submit the issue before a mediator. The decision of the mediator will not be binding.
    2. Any mediator must be a neutral party acceptable to both you and Carers Trust. The costs of any mediation will be shared equally between you and Carers Trust.
    3. Notwithstanding any other provision in these Terms and Conditions, you and Carers Trust agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
  15. Severability
    1. If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions.
    2. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
  16. Changes
    1. These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
  17. General
    1. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.
    2. These terms and conditions , together with the Privacy Policy and Cookies Policy, contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.
    3. The Contracts (Rights of Third Parties) Act 1999 shall not apply to these terms and conditions and no third party will have any right to enforce or rely on any provision of these terms and conditions.
    4. If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.
    5. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
    6. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts
